President?s Bush?s Statement on Signing of the ?Freedom to Display the American Flag Act of 2005?
Today, I was pleased to sign into law the ?Freedom to Display the American Flag Act of 2005.? Americans have long flown our flag at their homes as an expression of their appreciation for our freedoms and their pride in our Nation. As our brave men and women continue to fight to protect our country overseas, Congress has passed an important measure to protect our citizens? right to express their patriotism here at home without burdensome restrictions.

Asim is immensely grateful to his adopted country for all that is the United States, so much so that he has recently reduced hours on his full-time job to offer software training at no charge to wounded warrior veterans who need a new life. He has already begun training the first group on SAP software.

Behind his 35?-high detached single family home at Belmont Country Club, in Ashburn, VA, Asim has erected a flagpole and raised a flag that flew over the Navy Memorial in Washington, DC, on the 235th anniversary of the founding of the Navy. He has a certificate to prove it. The flag is not visible from the street in front of his house.

However, the Belmont Community Association wants him to take down the flagpole. Though the Belmont Country Club has five flagpoles of its own, each taller than the flagpole he erected, the community association wants his flagpole removed. Why? The reason is that their Policy Resolution #36 seeks to ?preserve the overall uniform aesthetics of the community?, which the Board considers to be a substantial interest of the Association.

Are all flagpoles prohibited? No. ?Flagpole staffs which do not exceed five feet in length and which are attached at an incline to the wall or pillar of a dwelling unit are permitted.?

Both the United States and Virginia have a ?Right to Display the American Flag Act.?

A condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent a member of the association from displaying the flag of the United States on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use.

Curiously, the association rules also require that ?The display of the American flag shall at all times be in accordance with any and all applicable Federal and State laws.?

However, Asim wonders, ?How can you fly a 3?5? flag at half-mast on a five-foot pole??

He did not set out trying to get every patriotic person in America fired up. He just wanted to fly the flag in his backyard. The flag that flew over the Navy Memorial building on the 235th anniversary of the founding of the United States Navy. Belmont Country Club, Ashburn, VA ? A Toll Brothers community has five of its flagpoles in common areas but considers this flagpole in his backyard a source of objection. Perhaps the Belmont Community Association ? HOA believes themselves more patriotic? Both the United States and Virginia have a ?Right to Display the American Flag Act.?

Here is a copy of the letter asking to take down the flagpole. Call CMC, the HOA to find out their justification for the above decision.
